*The Institute for Ethics in Public Life invites you to join us for
"Intellectual Property and AI" on Wednesday, April 30, at 3:30pm (in-person
and on Zoom) with special guest Prof. John Chambers of the Department of
Communications Studies.*
With the release of ChatGPT-3.5 in November, 2022, "artificial
intelligence" programs took a big step forward in capabilities. These new
"generative AIs" (large-language models -LLMs - and other AIs trained using
deep learning techniques) offer vast new possibilities to users. At the
same time, the creation and training of these models and their public use
raise a host of ethical and legal issues, of which a big one is related to
intellectual property. Intellectual property laws, such as copyright, are
important for protecting the rights of those who create and invent. This
becomes an issue for LLMs and the like because they are typically "trained"
using information (text, images, etc.) available on the internet. While
this information may be publicly available online, it is often still
protected by intellectual property laws. This raises an important legal and
ethical issue - is it appropriate and legal for the developers of AI models
to train their models using IP owned by others? Does this fall under "fair
use", or is this illegal expropriation of intellectual property? If the
latter, what kind of legal penalties could these firms suffer?
Another issue raised by these models is who, if anyone, has intellectual
property rights over their output? The individual who prompted the AI to
generate the output? The company that created the AI? No one?
There are currently more than 39 cases pending in U.S. courts dealing with
the issue of copyright and AI. Many of these have yet to reach the
discovery phase, so the legal questions they raise have yet to be
answered. However, some cases have been resolved, providing some insight
into how, and how well, intellectual property law can deal with the issues
raised by generative AIs. To help understand these issues, we'll explore:
1. A brief history of copyright.
2. What it means to be an author in the current age of AI.
3. Some of the interesting cases still pending in the court system.
Professor John M. Chambers is an assistant professor in the Department of
Communication Studies. He teaches courses in broadcast journalism,
television station management, television studio production and television
station operations which gives students the opportunity to run the campus
television station, Plattsburgh State Television. He received his
bachelor’s degree in television and radio production from the University of
Wisconsin-Eau Claire and his law degree from Creighton University. In
addition to an extensive career in television production that includes
founding a public access TV station and 12 years of directing live
television in a variety of markets, he has been a practicing attorney and
taught law for four years in the Commonwealth of the Northern Mariana
Islands. His research interests include Artificial Intelligence and its use
in broadcast media and production.
